Terms of use
HygiControl mobile apps and web interfaces

These terms define the rules for access to and use of the HygiControl service published by EASYTECH SOLUTIONS. They apply to every User, regardless of role. Financial terms (offers, duration, payment, hardware) are governed by the General Subscription Terms concluded with the professional Client. In case of conflict, the General Subscription Terms prevail over these terms. If language versions diverge, the French version prevails.
Article 1 — Definitions and scope
- Publisher

- Service
- The whole formed by the HygiControl mobile applications, web interfaces and related services.
- Client
- The professional subscription holder, responsible for the organisation created in the Service.
- User
- Any person with access to the Service: owner, establishment manager or employee.
- Establishment
- Each physical site linked to the Client’s organisation.
- Content
- Data entered in the Service by the Client and its Users.
The Service is intended for professional use only. It is not designed to be used by persons under sixteen years of age.
Article 2 — Acceptance of the terms
Use of the Service requires prior and unreserved acceptance of these terms. Acceptance takes place through a positive action by the User, before subscription for the Client, and upon first sign-in for other Users.
The Publisher keeps a record of this acceptance: User identity, date, time and version of the terms accepted. These terms are accessible at any time from the website, from the applications and before any account is created.
The Client warrants that all of its Users will comply with these terms and communicates their content to them.
Article 3 — Accounts, credentials and security

- Each account is strictly personal and nominative. Sharing the same account among several people is prohibited.

- The User is responsible for the confidentiality of their credentials and for any action carried out from their account.

Article 4 — Provision of the Service, availability and maintenance
The Publisher uses reasonable means to ensure the accessibility and proper operation of the Service. It is bound by an obligation of means and does not commit to any quantified availability rate.
The Service may be interrupted, in particular for maintenance, updates, failure of a technical provider, the internet network or distribution platforms. Scheduled maintenance is, where possible, performed outside service hours and announced in advance, with an indicative notice of forty-eight hours, by email to managers and by notification in the Service. Urgent security interventions may be carried out without prior notice.
Offline use. Some modules allow data entry without a network: data are kept on the device and transmitted when connectivity is restored. This transmission depends on the User’s technical environment and cannot be guaranteed. It is for the User to check that entries have been synchronised. Attendance punching requires an active connection.
Compatibility. The Service requires a device running iOS 15.5 or later, or Android 7.0 or later, and an internet connection. The Publisher may require installation of a minimum app version for security or compatibility reasons, and may evolve these prerequisites.
Developments. The Publisher evolves the Service and may modify, add or remove features. No substantial subscribed feature will be removed without prior notice to the Client and, where appropriate, proposal of an equivalent solution.

Article 6 — User obligations
The User undertakes to use the Service in accordance with its purpose, applicable regulations and these terms. In particular, the User undertakes to:
- provide accurate, truthful and complete information, and keep it up to date;
- actually perform the checks they record, and record only findings that match reality;
- not backdate, falsify or have a third party record an operation they did not perform;
- preserve the confidentiality of their credentials and use only their own account;
- respect individuals’ rights when taking photographs on the premises.
Article 7 — Prohibited uses
The following are expressly prohibited:
- reselling, renting, making available or sharing access to the Service for the benefit of a third party, in any form whatsoever;
- sharing an account among several people;
- automated or bulk extraction of Service data, use of robots, scraping scripts or any equivalent process;
- circumventing technical limitations, API request quotas or security measures;
- decompilation, reverse engineering or any attempt to access source code, except as provided by law;
- any action likely to disrupt, overload or compromise the Service or its infrastructure, as well as any attempt to access data not intended for the User;
- use of the Service for unlawful purposes, or in a way that undermines the evidential value of hygiene records.
The Publisher applies limits on the number of requests to the Service in order to preserve its stability. It may restrict use that is clearly excessive relative to normal use, notably as regards storage volume. File uploads are limited to five megabytes per image and fifteen megabytes per document.
Article 8 — Sanctions and suspension
In the event of a breach of these terms, the Publisher may apply the following measures on a graduated basis:

In the event of serious fault affecting the security of the Service, third-party rights or constituting fraud, suspension may occur immediately and without prior warning, the Client being informed without delay.
Article 9 — Content, ownership and Publisher access
Ownership of Content. Content remains the Client’s property. The Publisher processes it only for performance of the Service and undertakes not to assign it or use it for its own commercial purposes.
Aggregated statistics. The Publisher may produce aggregated and anonymised statistics that do not allow identification of the Client, an Establishment or a person, in order to improve the Service and produce sector analyses.
Intellectual property. The Service, its components, documentation and model documents provided remain the Publisher’s exclusive property. The subscription grants a personal, non-exclusive and non-assignable right of use for its duration.
Model documents. The food safety management plan, protocol sheets and model registers are licensed for internal use by the Client’s Establishments for the duration of the subscription. At the end of the contract, the Client retains internal use of documents it has downloaded and exports it has made, excluding any redistribution, resale or public availability.
Exports. The Client may export its data in spreadsheet and PDF formats from the Service, autonomously, at any time during the subscription.
Publisher access. Authorised Publisher staff have an administration access enabling management of organisations and accounts, reset of access and support operations. These actions are logged. The Publisher does not sign in to the Service as a User.
Article 10 — Personal data
The Client is the controller of its Users’ personal data; the Publisher acts as a processor within the meaning of Article 28 of Regulation (EU) 2016/679. Arrangements are described in the Privacy Policy and in the data-processing agreement concluded with the Client.
It is for the Client to inform its Users of the deployment of the Service, to complete the formalities incumbent on it and, where appropriate, to consult staff representatives, in particular when it enables features that allow activity monitoring. The Publisher makes information templates available for this purpose.
Users exercise their rights with their employer. Any request sent directly to the Publisher is forwarded to the employer.
Article 11 — Liability
Model documents are provided for information and are templates for the Client to adapt to the reality of its Establishment. They do not constitute legal advice.
The Publisher’s liability may be engaged only in the event of proven fault and within the limit of direct and foreseeable loss. Indirect damages are excluded, including loss of business, loss of turnover, loss of customers, reputational harm, administrative penalties and closures ordered by authorities.
The Publisher’s total liability, from all causes combined, is capped at the amounts actually paid by the Client in respect of the twelve months preceding the triggering event. These limitations do not apply in cases of wilful misconduct, gross negligence or personal injury.
The Publisher is not liable for interruptions attributable to the internet network, the User’s equipment or configuration, app distribution platforms, failure of a technical provider or force majeure within the meaning of Article 1218 of the French Civil Code, nor for the consequences of erroneous, late or missing entry.
Article 12 — Amendment of the terms, governing law and disputes
The Publisher may amend these terms. Users and Clients are informed by email and by notification in the Service. The new terms take effect thirty days after that notice. In the event of a substantial adverse amendment, the Client may terminate free of charge during that period.
These terms are governed by French law. The parties shall endeavour to resolve any dispute amicably, by written request to the other party. Failing agreement within thirty days, the dispute shall be brought before the commercial court of Bobigny, which has exclusive jurisdiction.
If any clause of these terms were held null or unenforceable, the remaining clauses would retain their full effect.
